Wills and Trusts

California Attorneys Offering Comprehensive Estate Planning Services

Myers, Widders, Gibson, Jones & Schneider, L.L.P. (“MWGJS”) provides complete estate planning services to clients throughout various stages of life. Estate planning is the process of "putting your affairs in order" to ensure your hard-earned assets are protected and will pass to the persons you intend. It is neither difficult, nor time consuming to protect your assets and your family's future with an estate plan. With the help of an experienced attorney you can have peace of mind that your loved ones will receive your property and understand your last wishes.

Drafting a Will

At MWGJS we help our clients draft their wills. Wills are not just about who gets what. A will is a formal legal document stating how you want your estate distributed. It is submitted to the court after you die. Creating a will is the simplest form of estate planning. Essentially, you tell the court in writing, with certain formalities, how you want your assets distributed and who will be responsible for the distribution. A will also tells the court who you want to be named as the guardian of your minor children.

Trusts

A Trust is a separate legal entity that controls the assets you place into it. You are known as the Trustor of the trust, since you were the one who created it. The Trustor decides who gets income and/or principal payouts from the trust. The people receiving the payouts are known as Beneficiaries. The person who administers the trust is the Trustee. The rules that you dictate for the trust to follow (how long the trust should last, who gets what, and other rules the trustee has to follow) are known as the Trust Terms. The document that defines the trust is known as the Trust Agreement. Trusts can be powerful tools when used properly. Trusts are useful devices to avoid probate or the need for a conservatorship on incapacity.

Please contact MWGJS to arrange a free phone consultation about any of the following Trusts.

· Credit shelter trust (A-B Trusts)

· Disclaimer trust

· Revocable trust / Irrevocable trust

· Life insurance trust

· Grantor retained annuity trust

· Charitable Remainder trust

Conservatorships and Guardianship

Instances arise when people are not capable of managing financial, personal or household affairs. An illness or disability at any age can result in the need for a family member to step in and make important decisions. Contact our conservatorship and guardianship lawyers at MWGJS. We can help you and your family obtain temporary or permanent conservatorship for an elder or other family member. We also assist families with guardianships for minor children and conservatorships for financial decision making on behalf of incapacitated adults.
